Terms of Use

1. Acceptance

These Terms of Use (also serving as the End User License Agreement, or "EULA") govern your use of the AGMechanicweb app and mobile apps (collectively, the "Service").AGMechanicis operated by Michael DeMore, a sole proprietor based in Tennessee, USA ("we", "us", "our"). By creating an account or using the Service, you agree to these terms.

2. Eligibility

You must be at least 18 years old to use the Service. You agree to provide accurate information when creating your account and to keep it up to date.

3. Your Account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own business purposes, subject to these terms. You may not sublicense, resell, copy, modify, or reverse engineer the Service or any part of it.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these terms
Attempt to access data belonging to other users
Interfere with or disrupt the Service or its servers
Use automated tools to scrape, harvest, or extract data
Upload malicious code, viruses, or content that infringes third-party rights

6. Your Content

You retain ownership of the jobs, customers, equipment, notes, photos, and other content you create in the Service ("Your Content"). You grant us a limited license to host, store, and display Your Content solely to operate the Service for you. You are solely responsible for Your Content and for ensuring you have the rights to upload it.

7. Subscriptions

The Service offers paid subscription tiers (Supporter, Pro, Business) on a monthly auto-renewing basis. Subscriptions purchased through the Apple App Store or Google Play are billed and managed through those platforms; subscriptions purchased on the web are billed and managed through Stripe.

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before renewal. You can manage or cancel your subscription at any time:

iOS — Settings → Apple ID → Subscriptions
Android — Google Play → Subscriptions
Web — Your account settings on agmechanic.app

8. Refunds

Subscriptions purchased through the Apple App Store or Google Play are subject to those platforms' refund policies. Refund requests for web subscriptions should be sent to support@agmechanic.app and will be considered on a case-by-case basis.

9. AI Features

When you use AI features in the Service, relevant job or equipment details are sent to the Anthropic Claude API. See our Privacy Policy for details. AI output is provided as an assistive tool and should not replace your professional judgment as a mechanic.

10. Service Changes & Termination

We may modify, suspend, or discontinue any part of the Service at any time. We may suspend or terminate your account if you breach these terms. You may stop using the Service and delete your account at any time within the app.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of another party.

14. Apple-Specific Terms

If you obtain the iOS app through the Apple App Store, the following terms apply in addition to the rest of this agreement:

This agreement is between you and us; Apple is not a party to it. We — not Apple — are solely responsible for the iOS app and its content.
Apple has no obligation to provide maintenance or support for the iOS app.
In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the iOS app.
We — not Apple — are responsible for addressing any claims you or any third party have relating to the iOS app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, claims under consumer protection law, and intellectual property claims.
You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.

15. Governing Law

These terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Tennessee.

16. Changes to These Terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
